Photo Submission Terms and Conditions

Please read these Photo Submission Terms and Conditions before sending us any photo, video, testimonial, review, caption, message, or other content. By sending or uploading content to Twice As Good Hair, you confirm that you have read, understood, and agreed to these Terms. If you do not agree, please do not submit content to us.

These Terms apply whenever content is submitted to [Legal Company Name], doing business as Twice As Good Hair, through our website, email, direct message, text message, social media, customer support, or any other submission channel. “Twice As Good Hair,” “we,” “us,” and “our” refer to [Legal Company Name] and its affiliates, successors, licensees, service providers, advertising partners, and agents.

1 Content Covered by These Terms

These Terms cover all photographs, videos, audio recordings, written statements, reviews, before and after images, progress photos, captions, messages, and other materials that you voluntarily send or upload to us, together with any first name, general location, age range, social media handle, likeness, image, voice, or other details you include. We refer to all of these materials as “Submitted Content.”

Merely tagging or mentioning Twice As Good Hair in a public social media post does not automatically give us permission to use that post in our marketing. These Terms apply when you intentionally send or upload content to us, or when you respond affirmatively to a request from us that links to these Terms.

2 Permission to Use Submitted Content

You keep any ownership rights you have in your Submitted Content. By submitting it, you give Twice As Good Hair a worldwide, nonexclusive, royalty free, fully paid, sublicensable, and transferable license to store, reproduce, edit, crop, resize, adapt, combine, translate, publish, display, distribute, and otherwise use the Submitted Content for our business and marketing purposes.

We may use the Submitted Content in any media or format, whether now known or developed later, including on our websites, product pages, social media accounts, email, digital and print advertisements, retail displays, presentations, public relations materials, educational materials, and internal training. We may use it with or without your first name, general location, or social media handle. We may also choose not to use it.

We may make reasonable edits for length, clarity, formatting, privacy, or presentation. We will not knowingly edit your content in a way that materially changes the meaning of your statements or falsely represents your experience.

3 How Long Permission Lasts

This permission begins when you submit the content and continues until you withdraw it as described below. You may ask us to stop using particular Submitted Content in future marketing by emailing [privacy@yourdomain.com] and providing enough information for us to identify you and the content.

After confirming your request, we will stop selecting the identified content for new marketing and will use commercially reasonable efforts to remove it from digital channels we control within [30] days. Your request will not require us to recall, destroy, or change materials that were already printed, distributed, published, committed to a campaign, or retained for legal and recordkeeping purposes. We cannot control copies, shares, or reposts made by other people or platforms.

4 No Payment or Approval Required

Unless we agree otherwise with you in writing, you will not receive payment, royalties, free products, discounts, or other compensation for our use of Submitted Content. To the extent permitted by law, you waive any right to inspect or approve the finished materials, advertising copy, or the specific placement in which your Submitted Content appears.

5 Your Promises

By submitting content, you confirm that:

you are at least 18 years old and legally able to agree to these Terms;

you created the Submitted Content or otherwise own or control every right needed to give us the permission described above;

each identifiable person shown or heard in the Submitted Content is at least 18 years old and has given permission for the submission and marketing uses described in these Terms;

the Submitted Content does not violate any copyright, trademark, privacy, publicity, confidentiality, contractual, or other right;

your statements reflect your honest opinions and actual experience, and any factual statements are accurate to the best of your knowledge;

you have told us about any payment, free product, discount, employment, family relationship, or other connection that could affect how someone evaluates your statements; and

you have not used filters, retouching, extensions, wigs, fibers, lighting changes, or other techniques in a way that materially misrepresents the results shown unless you clearly disclose it to us.

6 Progress Photos and Customer Results

Hair and scalp results vary from person to person. Submitting progress photos does not mean that we will publish them or that your experience is typical. If we use Submitted Content in advertising, we may add disclosures or explanatory context about timing, product use, compensation, image treatment, or the results consumers generally can expect.

Do not submit statements that diagnose a condition, promise a cure, or claim that a cosmetic product treats or prevents a disease. If your submission reveals a health condition or other sensitive information, you understand that your decision to submit it is voluntary and authorize us to process that information as reasonably necessary for the uses described in these Terms, subject to our Privacy Policy and applicable law.

7 Minors and Other People

Do not submit content that shows or identifies anyone under 18. Content involving a minor requires a separate written release from the minor’s parent or legal guardian before we may use it. If another adult appears or can be identified in your Submitted Content, you must obtain that person’s permission before submitting it. We may request proof of permission.

8 Privacy

We handle personal information associated with Submitted Content as described in our Privacy Policy at [insert Privacy Policy link]. The Privacy Policy explains what information we collect, why we use it, how long we keep it, when we disclose it, and the privacy rights that may apply to you. Please do not submit information that you do not want us to receive or potentially publish as permitted by these Terms.

9 Release of Claims

To the fullest extent permitted by law, you release Twice As Good Hair and its affiliates, successors, licensees, service providers, advertising partners, officers, employees, and agents from claims arising from an authorized use of the Submitted Content under these Terms, including claims based on rights of publicity or privacy, false light, defamation, copyright, moral rights, alteration, or use of your name, image, likeness, voice, or statements. This release does not cover a use outside the permission you granted, our material breach of these Terms, or liability that cannot legally be waived.

10 Third Party Claims

To the fullest extent permitted by law, you agree to reimburse us for reasonable losses, liabilities, damages, and expenses, including reasonable legal fees, arising from a third party claim that your Submitted Content or your breach of the promises in Section 5 violates that third party’s rights. This obligation does not apply to the extent a claim results from our material alteration of the content or our use outside the scope of these Terms.

11 Changes to These Terms

We may update these Terms from time to time. The version that applies to a submission is the version posted when the content is submitted. Changes will not expand our rights to content you previously submitted unless you agree to the updated terms or applicable law permits the change.

12 General Terms

These Terms, together with our Privacy Policy and any other terms presented when you submit content, are the complete agreement regarding the Submitted Content. If any provision is unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue in effect. Our failure to enforce a provision is not a waiver.

These Terms are governed by the laws of [State], without regard to conflict of laws rules. Any dispute will be resolved in the state or federal courts located in [County, State], and you consent to those courts, except where applicable law gives you the right to bring a claim elsewhere.
